Krugman, o "libertarianism" e os derrames de petróleo (II)

Em resposta às criticas que lhe foram feitas a propósito deste artigo, Krugman responde:

I pointed out that the libertarian alternative to regulation — just use tort law to make people pay for the damage they cause — doesn’t work in practice, because when push comes to shove politicians will shield the rich and powerful from paying the real cost. Commenters say, but isn’t that an equally strong reason to believe that regulation won’t work either?


Well, here’s the thing: regulation demonstrably does work where tort law doesn’t. Consider the environmental issue: in reality, the perpetrators of oil spills never pay most of the cost; but in reality, environmental regulation has led to much cleaner air and water. (Look up the history of Los Angeles smog or the fate of Lake Erie if you don’t believe me.)

Nesta resposta, Krugman parece-me estar a usar um double standard para avaliar dos méritos da regulação vs. indemnização - para considerar a solução "regulação" como boa, basta-lhe estar ter reduzido a poluição; mas como a solução "indemnização" não resolve completamente os problemas causados pela poluição, é má . Mas também se podia fazer o raciocínio exactamente inverso - afinal, o sistema de indemnizações também reduz bastante os problemas de poluição (se a BP e a Exxon não tivessem que pagar indemnizações de certeza que haveria muitos mais derrames de petróleo do que há); e o sistema de regulação também não resolve completamente os problemas (afinal, continua a haver poluição).

So why does regulation work? If polluters can buy off the system ex post, after a disaster, why don’t they manage to totally corrupt regulation ex ante? There’s a lot to say about that, and I’m sure there’s a literature I haven’t read. 

A impressão que me dá é que Krugman está a dizer que não sabe bem porque é que a regulação funciona (um resposta simples seria a de que talvez não funcione melhor que o sistema alternativo, apenas parecendo melhor devido ao tal double standard que o economista adoptou) .
